Are Employees Personally Liable for Hazmat Violations?

Usually not, unless it’s a supervisor, manager or executive who intentionally chooses to ignore the training requirements, or other regulations.  Though it is rare, intentional disregard of the regulations can result in criminal prosecution of the employee in addition to the company who may face a civil liability. The DOT uses the term “knowing” versus “willful”.  The former is generally a civil penalty and the latter may also be a criminal prosecution – especially if the violation results in damage to property, injury or death.
